BMF Partner Phil Federico spoke with WYPR about the ongoing PFAS contamination lawsuits against W.L. Gore & Associates, including the recent court ruling granting a Maryland family’s motion to intervene in the state’s case and become equal parties in the lawsuit. The court dismissed Gore’s attempt to block the motion, allowing the family to join Maryland’s Resource Conservation and Recovery Act (RCRA) lawsuit and ensuring that the interests of affected community members are represented.
Cheryl and Stephen Martin, along with the state of Maryland, allege that Gore knowingly allowed PFAS, commonly known as “forever chemicals,” to seep into groundwater, despite evidence from the 1980s that these chemicals posed serious health risks.
“This case is more about enforcing the federal statutes that exist that would relate to this PFAS contamination, and it’s more about remediation,” said Federico.
The ruling enables the Martins and other residents to fully participate in Maryland’s RCRA lawsuit, which seeks to remediate the environmental damage and prevent future harm.
BMF also currently represents hundreds of affected families in the ongoing class action litigation, working to help them secure justice, accountability, and meaningful remedies for those harmed by PFAS exposure.
