BMF Partners John Paradee and Mark Denney secured a $5 million verdict against the Delaware Department of Transportation in an eminent domain case for a Delaware landowner. The verdict was covered by CoastTV and The Cape Gazette.
The case centered on land the state acquired via eminent domain at the intersection of Route 1 and Route 16 in 2021. DelDOT used the land as part of its project to build a grade-separated intersection in the area.
DelDOT had initially offered $1.48 million for the land and $144,700 for the easement, claiming those figures reflected the highest appraisals of fair market value available. BMF worked closely with land-appraisal experts who valued the property at $5.25 million. The jury ultimately sided with their assessment, awarding $5.015 million to the owners, more than three times DelDOT’s original offer.
