The motion was filed after Perdue canceled a scheduled three-day mediation session just weeks before it was set to begin, following months of preparation by the parties.
Phil said: “Perdue never had any serious intention of resolving this case in good faith. Instead, Perdue used the stay to buy time, shift blame to other companies and avoid confronting its own responsibility for the contamination affecting Salisbury families. Salisbury families deserve answers and action, not more delay and finger-pointing.”
BMF filed a class-action lawsuit in 2024 on behalf of thousands of residents affected by PFAS contamination near Perdue’s Salisbury facility. The lawsuit seeks financial damages and full remediation of contaminated soil, groundwater, and surface water. In August 2025, a federal judge rejected Perdue’s motion to dismiss the case, allowing it to move forward.
