Brockstedt Mandalas Federico Partners Philip Federico and Chase Brockstedt were featured in WBOC’s coverage of the firm’s July 28 motion asking the court to lift the stay in its PFAS contamination case against Perdue Farms and impose sanctions on the company. The motion was filed after Perdue canceled a three-day mediation session roughly two weeks before it was set to begin, and two days before its mediation statement was due.
According to the filing, case deadlines were suspended for a total of 137 days while the parties prepared for mediation. Days after the second stay was requested, Perdue moved to add two firefighting foam manufacturers as third-party defendants, despite having identified AFFF foam as a potential PFAS source roughly 18 months earlier.
The underlying federal lawsuit was brought on behalf of Salisbury, Maryland residents whose groundwater, private wells, and residential properties were allegedly contaminated by PFAS originating from Perdue’s agribusiness facility on Zion Church Road.
Phil told WBOC that Perdue used the stay to buy time and shift blame to other companies rather than confront its own responsibility for the contamination, and that Salisbury families deserve answers and action instead of continued delay. Chase emphasized that families are still living with the consequences of the contamination and that the firm will keep pressing to hold Perdue accountable and move the case forward.
